CONDITIONS FOR THE ISSUING OF THE PERMIT FOR THE PROVISION OF THE FOLLOWING HOSPITALITY ACTIVITIES: HOTEL, MOTEL, BOARDING HOUSE, TOURIST SETTLEMENT, HOSTEL, TOURIST APARTMENT BLOCK, ETHNO VILLAGE, NATIONAL RESTAURANT, ETC.

Business entities, other legal entities and entrepreneurs, when submitting the application for the issuing of the permit for the provision of a hospitality activity in accordance with Article 66, paragraph 1 and Article 74, in conjunction with Article 83 of the Law on Tourism and Hospitality (“Official Gazette of Montenegro”, no. 02/18, 04/18, 13/18 and 25/19) are also obliged to submit the following:
1. To prove ownership rights or the right to disposal or use of the hospitality facility constructed in accordance with the construction regulations:
- public document (immovable property certificate) and
- document of legal transaction concluded in accordance with the law (certified contract, etc.) in case of use or disposition of a hospitality facility
2. To prove the compliance with the conditions concerning staff (manager of hospitality facility):
- full-time employment contract, unless the manager of the hospitality facility is the CEO of the business entity;
- proof of completion of a minimum of level four of qualifications, sublevel IV 1 of the National Qualifications Framework,
3. Completed form for entry into the Central Tourism Register (CTR)
4. Proof of payment of the amount of 2 euros for the submission of the application to the bank account of the Ministry, no. 832-31614150-79 (Law on Administrative Fees)
If the hotel is intended to be used for the condo model of operation:
- The hotel must possess a minimum five-star category in the coastal region or in the Capital City and a minimum four-star category in the northern and central regions, except for the Capital City, which is operational for 12 months of the year;
- Accommodation units at the hotel which operates according to the condo model shall be subject to individual division and must operate commercially for at least 10 months during the year;
- Accommodation units shall be registered individually in the immovable property cadastre subject to the requirement that the unit is managed by the manager in accordance with the Law on Tourism and Hospitality;
- In addition to the proof of the issuing of the permit for the provision of hospitality activities for the condo model of operation, it is also necessary to submit the concluded agreements on purchase and sale, and on management and maintenance;
If the hotel is intended to be used for the mixed-use model of operation:
- The hotel must possess a minimum five-star category and a minimum capacity of 120 accommodation units in the coastal region and in the Capital City and a minimum four-star category and a minimum capacity of 60 accommodation units in the central and northern regions, except for the Capital City, which is operational for 12 months of the year;
- The accommodation units at the mixed-use model of operation hotel may be subject to individual sale with the possibility of optional rental on a voluntary basis;
- The accommodation units shall be rented exclusively through the manager or hotel operator who manages the hotel as a whole;
- The percentage of accommodation units of the hotel intended for sale may not exceed 50% of the total accommodation capacities of the hotel;
- Exceptionally, at a hotel of minimum five-star category with a minimum capacity of 240 accommodation units in the coastal region and in the Capital City, and a minimum four-star category with a minimum capacity of 120 accommodation units in the central and northern regions, except for the Capital City, the percentage of accommodation units intended for sale may not exceed 60% of total accommodation capacities;
- The accommodation units in hotels with mixed-use model of operation shall be entered into the immovable property cadastre subject to the requirement that the residential unit is managed by the manager in accordance with the Law on Tourism and Hospitality;
- The accommodation units must be part of a hospitality facility which constitutes a single unit in terms of business operations, management and maintenance;
- Management of the hotel may be delegated to the hotel operator by means of an agreement;
- Sale of the residential units must not change the purpose and business activity of the hospitality facility – hotel as a business facility;
- In addition to the listed proof for the issuing of permits for the performance of the hospitality activities for the mixed-use model of operation, it is also necessary to submit the concluded agreements on purchase and sale, and on management and maintenance;
The application for issuing of a work permit for a hospitality facility must contain data that relates to the title, address and form of business activity, tax identification number and the registration number from the Central Register of Business Entities (CRPS); as well as the address, title and type of hospitality facility where they will operate.
Also, the application must include the contact phone number of the person that will monitor the compliance with the minimum technical conditions with regards to space, equipment and resources.
In addition to the compliance with the minimum technical conditions with regards to space, equipment and resources proscribed by the Rulebook on Types, Minimum Technical Conditions and Categorisation of Hospitality Facilities (“Official Gazette of Montenegro”, no. 36/18), the hospitality facilities must comply with other conditions proscribed by separate regulations (general and particular hygiene conditions, occupational health and safety, etc.). The control of the compliance with these conditions shall be performed by competent inspectors (Article 79, paragraphs 4 and 5 of the Law).
