CONDITIONS FOR THE ISSUING OF THE PERMIT AND LICENCE FOR THE PROVISION OF THE ACTIVITIES OF A TOURIST AGENCY

Business entities, other legal entities and entrepreneurs, when submitting the application for the issuing of the licence and decision on the approval to perform the activities of a tourist agency – travel organiser or tourist agency agent (office – branch office), in accordance with Article 9 and Article 15, in conjunction with Articles 17, 18 , 19 and 20 of the Law on Tourism and Hospitality (“Official Gazette of Montenegro”, no. 02/18, 04/18, 13/18 and 25/19) shall also submit the following:

1. To prove the ownership rights or the right to disposal or use of the business premises of the office – branch office of the tourist agency:
- public document (immovable property certificate) and
- document of legal transaction concluded in accordance with the law (certified contract, etc.) in case of use or disposition of business premises

2. To prove the compliance with conditions concerning staff (tourist agency manager):
- employment contract and employment registration with the tax administration,
- proof on the completion of level four of qualifications, sublevel IV 1 of the National Qualifications Framework,
- knowledge of at least one foreign language at a minimum of level B1 on the CEF scale, and
- appropriate document on work experience in the field of tourism
(3 years of work experience for a tourist agency – travel organiser and
1 year of work experience for tourist agency agent)

3. To prove security interest:
- irrevocable bank guarantee of performance which is payable on first demand and without objection, or
- insurance policy, or
- monetary deposit in the special account at the commercial bank
for every office and branch office in the amount of 15,000 euros for a tourist agency – travel organiser, and/or 7,000 euros for a tourist agency agent.

4. Adequate proof on generated total revenue of the agency in the previous year (balance sheet)

5. Completed form for entry into the Central Tourism Register (CTR)

6. Proof of payment of the amount of 2 euros for the submission of the application to the bank account of the Ministry, no. 832-31614150-79 (Law on Administrative Fees)
The activities of tourist agencies may be performed in a residential space, exclusively online.
If the activity of a tourist agency is intended to be performed exclusively online, in addition to the previously listed proof, it is necessary to also submit proof of the residence of the manager of the tourist agency at the address of the residential premises where the activity is intended to be performed.

The application for issuing of a work permit – licence for a tourist agency must contain data that relates to the title, address and form of business activity, tax identification number, and the registration number from the Central Register of Business Entities (CRPS); as well as the address of the office – branch office of the tourist agency, and the title and type under which they will operate.

Also, the application must include the contact phone number of the person that will monitor the compliance with the minimum technical conditions with regards to space, equipment and resources.

In addition to the compliance with the minimum technical conditions with regards to equipment and resources, the office – branch office must comply with other conditions proscribed by separate regulations (conditions for construction, general and particular hygiene conditions, occupational health and safety, etc). The control of the compliance with these conditions shall be performed by competent inspectors (Article 18, paragraphs 2 and 3 of the Law).
