Conditions for issuing a permit for performing the activities of a travel agency and a license

Companies, other legal entities and entrepreneurs with a request for the issuance of a license and a decision on approval to perform the activities of a travel agency of the type of travel organizer or intermediary (branches), in accordance with Articles 9 and 15, and in connection with Art. 17, 18, 19 and 20 of the Law on Tourism and Catering ("Official Gazette of Montenegro", No. 02/18, 13/18, 25/19, 67/19 and 76/20) submit:

1. To prove the right of ownership or the right to dispose of or use the business premises of the branch office of a travel agency:

- public document (excerpt from the real estate folio) and

- a document on a legal transaction made in accordance with the law (certified contract, etc.) if it is about the use or disposal of business premises

2. To prove the fulfillment of conditions for staff (manager of the travel agency):

- employment contract with an application for employment with the tax administration,

- proof of completion of the fourth level of qualification sub-level IV 1 of the national qualifications framework,

- knowledge of one foreign language minimum B1 level with CEF scale and

- appropriate document on work experience in tourism (3 years of work experience for a travel agency travel organizer and 1 year of work experience for a travel agency intermediary)

3. To prove the guarantee:

- an irrevocable bank guarantee for good performance of services which is payable on the first call and without objection, or

- insurance policy or

- balance of cash deposit on a special account with a commercial bank for each branch and sub-branch in the amount of € 15,000.00 for a travel agency - travel organizer, or € 7,000.00 for a travel agency - intermediary.

4. Appropriate proof of the total revenues of the agency in the previous year (balance sheet and income statement)

5. Completed form for entry in the Central Tourist Register (CTR)

6. Proof of payment of the amount of € 2.00 for submitting a request to the bank account of the Ministry no. 832-31614150-79 (Law on Administrative Fees).

The activity of travel agencies can also be performed in residential areas, exclusively via the Internet. If the activity of the travel agency is intended to be performed exclusively via the Internet (online), it is necessary to submit, in addition to the previously mentioned evidence, proof of residence of the manager of the travel agency at the residential address where the activity is intended.

In the application for the issuance of a work permit - travel agency license it is necessary to state the data related to the name, address and form of performing economic activity, personal identification number and registration number from the Central Register of Companies (CRPS); the address of the branch office of the travel agency, as well as the name and type under which it will operate.

Also, in the request, it is necessary to state the contact telephone number of the person who will monitor the determination of the fulfillment of the minimum technical requirements in terms of equipment and interior design.

In addition to meeting the minimum technical requirements in terms of equipment and interior design of office space - the travel agency branch must meet other requirements prescribed by special regulations (construction conditions, general and special hygiene requirements, safety at work, etc.). The control of the fulfillment of these conditions is performed by the competent inspection bodies (Article 18, paragraphs 2 and 3 of the Law).

Conditions for issuing approvals for performing activities of a tourist guide and their identification 

Pursuant to Article 36, paragraph 1 of the Law on Tourism and Catering (“Official Gazette of Montenegro”, No. 02/18, 13/18, 25/19, 67/19 and 76/20), a work permit and identification card are issued to a natural person who meets the following conditions:

- has an active knowledge of at least one foreign language, ie the language in which he / she provides the services of a guide;

- has knowledge of the Montenegrin language to the extent that enables basic communication for a foreign natural person;

- has a certificate of acquired national professional qualification for a tourist guide in accordance with the law.

Work permits and identification cards are issued on the basis of a request submitted to this Ministry as the competent body for determining the fulfillment of conditions for performing activities and receiveing identification cards (Article 37 of the Law on Tourism and Catering).

The application shall be accompanied by the following evidence:

- certificate of acquired national professional qualification for a tourist guide in accordance with the law;

- knowledge of the language in which they will provide services;

- knowledge of Montenegrin language to the extent that enables basic communication for a foreign natural person;

- completed form for entry in the Central Tourist Register;

- Copy of ID card or passport;

- Two passport-size images;

- Proof of costs of the procedure, payment of administrative fees to the account of the Ministry of Sustainable Development and Tourism no. 832-31614150-79 (Law on Administrative Fees tariff no. 4) in the amount of € 2.00;

- completed form for entry in the Central Tourist Register (CTR).

Conditions for issuing permits for performing tourist activity providing rafting services

A company, other legal entity or entrepreneur who intends to provide rafting services as a tourist activity is obliged to submit to this Ministry, as the competent authority for issuing work permits, pursuant to Article 37 of the Law on Rafting ("Official Gazette of Montenegro", No. 53/11). , 53/16 and 57/16):

1. A written request containing information on:

- name and registered office, ie name and surname, unique identification number and address of the service provider;

- data on the type of services and the rafting boat, ie the raft.

2. Certificate of acquired national professional qualification for boat or raft leader, ie IRF license for at least one person.

3. Certified copy (s): - Liability insurance policies for damage caused to third parties and - Insurance policy of service users.

4. Evidence of:

- registration of a company, other legal entity or entrepreneur (Excerpt from the Central Register of Companies),

- boat navigation permit (issued by the Captaincy) and

- Certificate of compliance with safety rules of navigation (issued by the Maritime Safety Administration) is obtained by the Ministry ex officio

5. Proof of payment of the administrative fee for the submission of application to the account of the Ministry of Sustainable Development and Tourism no. 832-31614150-79 (Law on Administrative Fees, tariff no. 4) in the amount of € 2.00.

Conditions for issuing a permit for performing activities (work) on a ski resort

The provision of services at the ski resort is performed in accordance with the conditions prescribed by the Law on Ski Resorts ("Official Gazette of the Republic of Montenegro", No. 13/07 and "Official Gazette of Montenegro", No. 14/11, 21/14 and 44/17). The applicant (company, other legal entity or entrepreneur) is obliged to submit to this Ministry, as the competent authority for issuing permits for the operation of ski resorts:

1. A written request containing information on:

- Name and seat of the company;

- TIN (registration number);

- Name and address of the ski resort for which the issuance of a permit for performing activities is requested;

- Contact phone no.

2. Proof of registration of the company, other legal entity or entrepreneur (Excerpt from the Central Register).

3. To prove the right of ownership or the right to dispose of or use a catering facility built in accordance with construction regulations:

- public document (excerpt from the real estate folio) and

- a document on a legal transaction made in accordance with the law (certified contract, etc.) if it is about the use or disposal of a catering facility.

4. Excerpt from the spatial planning documentation for the purpose of land for ski resorts. (Article 4 of the Law)

5. Proof of fulfillment of technical conditions on testing of steel ropes and electrical installations - opinion (study or opinion / expert finding) - issued by authorized entities.

6. Proof of provision of certain services at the ski resort: (Articles 33, 36, 40 and 41 of the law)

- rescue services (at least two rescuers with an authorized certificate);

- first aid services (providing a doctor at the ski resort or a doctor on duty;

- ski resort maintenance services and police services

7. Proof of conclusion of the contract on insurance of skiers and other direct users of ski resorts (Article 8 of the Law on Amendments to the Law on Ski Resorts - "Official Gazette of Montenegro", No. 21/14).

8. Proof of payment of the administrative fee of € 2.00 to the bank account of the Ministry of Sustainable Development and Tourism no. 832-31614150-79.

9. Completed form for entry in the Central Tourist Register (CTR)

Determining the fulfillment of conditions regarding the arrangement, maintenance, equipment and provision of services at the ski resort is performed by an authorized person of the ministry (Article 7 of the Law)

Companies, other legal entities and entrepreneurs with a request for the issuance of a permit to perform catering activities, in accordance with Art. 66 paragraphs 1 and 74, and in connection with Article 83 of the Law on Tourism and Hospitality ("Official Gazette of Montenegro", No. 02/18, 13/18, 25/19, 67/19 and 76/20) are obliged to submit:

1. To prove the right of ownership or the right to dispose of or use a catering facility built in accordance with construction regulations:

- public document (excerpt from the real estate folio) and

- a document on a legal transaction made in accordance with the law (certified contract, etc.) if it is about the use or disposal of a catering facility

2. To prove the fulfillment of the conditions for staff (manager of the catering facility):

- full-time employment contract, unless the manager of the catering facility is the executive director of the company;

- proof of at least completed fourth level of qualification sub-level IV 1 of the national qualifications framework,

4. Proof of payment of the amount of € 2.00 for submitting a request to the bank account of the Ministry no. 832-31614150-79 (Law on Administrative Fees)


If the hotel intends to perform a condo business model:

- The hotel must have a category of minimum 5 ***** stars in the coastal region and the Capital and a category of minimum 4 **** stars in the northern and central region except the Capital, and which is in operation for 12 months;

- Accommodation units in the hotel condo business model are subject to individual division and must be in commercial function, at least 10 months during the year;

- Accommodation units are individually registered in the real estate cadastre with the burden that the unit is managed by a manager in accordance with the Law on Tourism and Catering;

- In addition to the above evidence for the issuance of approvals for the performance of catering activities for the condo business model, it is necessary to submit concluded contracts for the sale, management and maintenance;


If the hotel intends to perform a mixed business model:

- The hotel must have a category of at least 5 ***** stars with a capacity of at least 120 accommodation units in the coastal region and the Capital and categories of at least 4 **** stars with a capacity of at least 60 accommodation units in the central and northern region except the Capital, and which is in operation for 12 months;

- Accommodation units in a hotel with a mixed business model can be subject to individual sale with the possibility of optional renting on a voluntary basis;

- Accommodation units are rented exclusively through the manager or hotel operator who manages the hotel as a whole;

- The percentage of accommodation units intended for sale may not exceed 50% of the total accommodation capacity of the hotel;

- Exceptionally in a hotel category minimum 5 ***** stars with a capacity of minimum 240 accommodation units in the coastal region and the Capital and categories minimum 4 **** stars with a capacity of minimum 120 accommodation units in the central and northern region except the Capital, percentage intended for sale may not exceed 60% of the total accommodation units;

- Accommodation units in hotels with a mixed business model are entered in the real estate cadastre with the burden that the accommodation unit is managed by a manager in accordance with the Law on Tourism and Catering;

- Accommodation units must be part of a catering facility that represents a single unit in terms of business, management and maintenance;

- Hotel management can be contracted out to a hotel operator;

- The sale of accommodation units must not change the purpose and activity of the catering facility - hotel as a business facility;

- In addition to the above evidence for the issuance of approvals for performing catering activities for a mixed business model, it is necessary to submit concluded contracts for the sale, management and maintenance;

In the application for the issuance of a permit for the operation of a catering facility, it is necessary to state the data related to the name, address and form of performing economic activity, personal identification number and registration number from the Central Register of Companies (CRPS); as well as the address, name and type of catering facility under which it will operate.

Also, in the application, it is necessary to state the contact telephone number of the person who will monitor the determination of the fulfillment of the minimum technical requirements in terms of space, devices and equipment.

In addition to meeting the minimum technical requirements in terms of space, devices and equipment prescribed by the Rulebook on types, minimum technical requirements and categorization of catering facilities ("Official Gazette of Montenegro" No. 36/18), catering facilities must meet other requirements prescribed by special regulations (general and special hygiene requirements, safety at work, etc.). The control of the fulfillment of these conditions is performed by the competent inspection bodies (Article 79, paragraphs 4 and 5 of the Law).

Conditions for issuing permits for performing catering activities of the rural household type

You can also submit an application for the issuance of a permit for performing catering activities of the rural household type electronically via the eGovernment Portal.

Companies, other legal entities, entrepreneurs or natural persons with a request for the issuance of a permit for performing catering activities of the rural household type, in accordance with Art. 66 paragraphs 1 and 2 and 74 and in connection with Art. 100 and 103 of the Law on Tourism and Catering (“Official Gazette of Montenegro”, No. 02/18, 13/18, 25/19, 67/19 and 76/20) submit:

1. If the services of the catering activity of the rural household type are performed within a company, another legal entity or as an entrepreneur, it is necessary to submit proof of registration (Excerpt from the Central Register of Companies (CRPS));

2. Proof of registration of a company, other legal entity, entrepreneur or natural person in the Register of Agricultural Holdings (Article 103, paragraph 2 of the Law);

3. To prove the right of ownership or the right of disposal, ie the use of a catering facility of the rural household type:

- For a natural person: proof of the right of ownership / co-ownership of the building - public document (excerpt from the real estate folio) or the right to use the building / land - certificate of the competent local government or local community proving the right to use;

- For a company, other legal entities or entrepreneurs: excerpt from the real estate folio and a document on legal business made in accordance with the law (certified contract, etc.) if it is about the use or disposal of a catering facility of the rural household type;

4. To prove the fulfillment of conditions for staff (manager of a catering facility) of a company, other legal entity or entrepreneur:

- full-time employment contract,

- proof of at least completed fourth level of qualification sub-level IV 1 of the national qualifications framework,

5. Completed form for entry in the Central Tourist Register (CTR)

6. Proof of payment of the amount of € 2 for submitting a request to the bank account of the Ministry no. 832-31614150-79 (Law on Administrative Fees).

Fulfillment of minimum - technical conditions in terms of space, devices and equipment in a catering facility of rural household type is performed by an authorized person of the ministry, in accordance with the Rulebook on minimum technical conditions, conditions for category and categorization of facilities in which services are provided in rural households.

In addition to meeting the minimum technical requirements in terms of space, devices and equipment, catering must meet other requirements prescribed by special regulations (requirements in terms of food safety, safety at work, etc.). The control of the fulfillment of these conditions is performed by the competent inspection bodies (Article 79, paragraphs 4 and 5 of the Law).

Catering services in a rural household can be provided by companies, other legal entities, entrepreneurs or a natural person (domestic or foreign) who is the owner / co-owner of the facility / floor, or land, up to 10 accommodation units - 20 beds (Article 100, paragraph 1 and 2 laws).

Within a catering facility of the rural household type, a natural person may also organize the provision of catering services of the camping type, for a maximum of 15 accommodation units, ie 30 persons at the same time in accordance with the Rulebook on classification, minimum technical conditions and categorization of camps, Official Gazette of MNE no. 61/11).

Companies, other legal entities and entrepreneurs with a request for the issuance of a permit to perform catering activities of the type of camp in accordance with Art. 66 paragraphs 1 and 74, and in connection with Art. 83 and 105 of the Law on Tourism and Catering (“Official Gazette of Montenegro”, No. 02/18, 13/18, 25/19, 67/19 and 76/20) submit:

1. To prove the right of ownership or the right to dispose of or use a catering facility built in accordance with construction regulations:

- public document (excerpt from the real estate folio) and

- a document on a legal transaction made in accordance with the law (certified contract, etc.) if it is about the use or disposal of a catering facility

2. To prove the fulfillment of the conditions for staff (manager of the catering facility):

- full-time employment contract,

- proof of at least completed fourth level of qualification sub-level IV 1 of the national qualifications framework,


3. Completed form for entry in the Central Tourist Register (CTR).

On the land for which no spatial planning documentation has been made, the Ministry may issue a temporary approval for the provision of services in the camp for performing that activity on the basis of a program of temporary facilities for a period of one year, with the consent of the competent local government body, ie the legal entity that manages the protected economic good.
