Customs transit procedure – NCTS

Transit is a special customs procedure that allows the movement of goods from the customs office of departure to the customs office of destination without being subject to import duties, other duties levied upon import or trade policy measures, if they do not prohibit the entry of goods into or exit from the customs territory of Montenegro. Transit can be national and common.

On 30 July 2025, the Parliament of Montenegro adopted the Law on the Ratification of the Convention on the simplification of formalities in trade in goods ("Official Gazette - International Treaties" No. 9/2025). By Decision No. 1/2025 of the Joint Committee of the EU and the countries of common transit established by the Convention on the simplification of formalities in trade in goods of 19 September 2025, Montenegro was invited to become a contracting party to this Convention from 1 November 2025.

The common transit procedure enables participants in the customs procedure to transport goods between the contracting parties to the Convention (the European Union, the EFTA countries, as well as the Republic of Turkey, the Republic of North Macedonia, Serbia, the United Kingdom, Ukraine, Georgia, Moldova and Montenegro) on the basis of a single electronic declaration and a single guarantee valid throughout the transit procedure. The Convention on a common transit procedure lays down the common transit procedure.

The national transit procedure is prescribed by the provisions of the Customs Law ("Official Gazette of Montenegro", 086/22, Articles 155 - 159), the Regulation on the detailed implementation method of customs procedures and customs formalities ("Official Gazette of Montenegro", No. 026/23, 097/23 and 104/25, Articles 400 - 454) and the Rulebook on the content and method of submitting customs declarations, types, forms, structures and data codes regarding declarations, requests or decisions used for the implementation of customs formalities ("Official Gazette of Montenegro", No. 050/25).

In addition to the above, the transit procedure can also be implemented:

a) by TIR carnet;

b) by ATA carnet;

c) by Form 302;

d) by postal system.
