Administrative inspection

Administrative Inspection is an organizational unit of the Ministry of Public Administration, Digital Society and Media that supervises the application of regulations governing state administration, rights and obligations of civil servants and employees, administrative procedure, appearance, use and procedure of making and destroying seals of state bodies, as well as prohibition of discrimination.

The tasks of administrative inspection are performed by the Chief Administrative Inspector and the Administrative Inspector. The inspector is independent in performing inspection supervision, within the rights and duties determined by law and other regulations.

Supervision over the application of regulations on administrative procedure

The Administrative Inspection performs inspection supervision over the application of the law regulating the administrative procedure at ministries and other administrative bodies, state bodies, local self-government bodies, local government bodies, institutions and other entities exercising public authority, in relation to: economy and efficiency of realization and protection rights and legal interests of the parties in administrative proceedings, use of language and script in administrative proceedings, actions of an authorized official conducting administrative proceedings and issuing an administrative act, fulfillment of conditions for concluding administrative contracts, compliance with the obligation to obtain information ex officio, compliance with legal aid parties in administrative proceedings, giving the possibility to the party in administrative proceedings, enabling review of the case file to the party in administrative proceedings, submitting the case file to the Administrative Court of Montenegro in connection with the initiated administrative dispute, issuing certificates and other documents on the facts about which the official records are kept and other actions of the subject of supervision, in accordance with the rules of administrative procedure.

Supervision over the application of regulations on state administration

The Administrative Inspectorate also inspects the application of laws and other regulations governing the state administration related to: providing the public with work and respecting obligations in relations with citizens at ministries and other administrative bodies, internal organizations in ministries and other administrative bodies, Pension and Disability Insurance Fund of Montenegro, Health Insurance Fund of Montenegro, Employment Bureau of Montenegro, Labor Fund and the Agency for Peaceful Settlement of Labor Disputes, compliance with the rules on office operations with ministries and other administrative bodies, state bodies, local self-government bodies, local government bodies, as well as other legal entities when performing transferred or entrusted tasks of state administration, unless otherwise prescribed by law and acting on petitions and complaints against the work of ministries and other administrative bodies.

Supervision over the application of regulations on civil servants and employees

The Administrative Inspection supervises the application of laws and other regulations governing the rights and obligations of civil servants and employees in accordance with that law.

Supervision over the application of other regulations

The Administrative Inspection performs inspection supervision over the application of laws and other regulations which regulate the appearance, use and procedure of making and destroying the seals of state bodies, and also performs inspection supervision in other areas.

Supervision in relation to the prohibition of discrimination

The administrative inspection performs inspection supervision in relation to the prohibition of discrimination in the areas for which it is competent.

What are the types of inspections?

Inspection supervision is performed as regular, extraordinary and control supervision. Regular inspection supervision is performed in accordance with the Work Plan of the Administrative Inspection. Extraordinary inspection supervision is performed on the order of the chief administrative inspector, the head of the state administration body responsible for administrative affairs or on the initiative of legal and natural persons. Control inspection supervision is performed in order to determine the execution of measures that have been proposed or ordered to the subject of supervision within the framework of regular or extraordinary inspection supervision.

How to initiate an inspection procedure?

The inspection procedure is initiated and conducted ex officio.

In performing inspections, the inspector is obliged to consider the initiative to initiate inspection procedures and inform the submitter of the initiative about that.
