Government adopts amendments to the Law on Foreigners – new measures to regulate residence

The Government of Montenegro has adopted amendments to the Draft Law on Amendments to the Law on Foreigners, introducing new measures for regulating the residence of foreign nationals in Montenegro.

One of the amendments, adopted at today’s electronic Cabinet session, defines that the minimum value of real estate based on which a foreign citizen may obtain temporary residence in Montenegro will be €200,000.

Current real estate owners who have regulated their temporary residence on this basis will be given a one-year deadline to bring their status in line with the new legal provisions.

Another amendment stipulates that foreign nationals who serve as executive directors or who own more than 51 percent of shares in a company must have at least three employees, two of whom must be Montenegrin citizens employed full-time.

Under the amended provisions, they will have 180 days to align their business operations with the new requirements.

In parallel with the new regulations, intensive work is underway to improve interinstitutional and international data exchange related to the entry and residence of foreigners in Montenegro.

In this regard, the Ministries of Foreign Affairs and Interior, together with the Ministry of Finance, the Tax Administration and the Police Directorate, have intensified cross-checking and data exchange in order to prevent potential abuses of residence permits. Based on data on inactive and insolvent companies owned by foreign nationals, checks will be carried out and, in accordance with the Law on Foreigners, procedures for revoking temporary residence will be initiated where legal conditions are met.

Following previous high-level consultations, and in cooperation with the competent institutions of Montenegro and Türkiye, an additional verification will be carried out regarding the data of approximately 13,500 Turkish citizens who currently hold temporary or permanent residence permits under the Law on Foreigners.
